Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and W4 Investments, doing business as WalkOn RX ("WalkOn RX," "we," "us" or "our"), governing your use of the WalkOn RX website, mobile experience and related telehealth services (together, the "Services"). By creating an account or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Acceptance of Terms
By accessing or using the Services, you confirm that you are at least 18 years old, capable of entering a binding contract and able to comply with these Terms. If you use the Services on behalf of another person, you represent that you have authority to do so.
2. Description of Services
WalkOn RX provides an online platform through which patients can complete a health questionnaire, connect with independent licensed clinicians for a telehealth consultation and, if the clinician determines it is medically appropriate, receive a prescription that is filled and shipped by a pharmacy partner The Pharmacy Hub. WalkOn RX itself does not practice medicine or pharmacy. Clinical services are provided by independent, licensed clinicians. 3. Eligibility and Service Area
The Services are available to residents of all 50 U.S. states. Availability of specific treatments, medications and fulfillment options may vary by state. Clinicians are licensed to practice in the state where you are located at the time of your consultation. Availability of specific treatments varies by state.
4. Your Account
You must create an account to use most Services. You agree to provide accurate, current information, to keep your login credentials confidential and to notify us promptly of any unauthorized use of your account. You are responsible for all activity under your account.
5. Acceptable Use
You agree not to:
• Provide false or misleading health information.
• Use the Services for any unlawful purpose or to obtain medication under false pretenses.
• Attempt to access another patient's account or records.
• Interfere with or disrupt the security or performance of the Services.
• Reverse engineer, scrape or resell any part of the Services without our written consent.
6. Medical Services Disclaimer
The Services facilitate access to independent licensed clinicians. WalkOn RX does not guarantee that any clinician will prescribe medication, that any treatment will produce a particular result, or that you will be approved for a given product. See the Medical Disclaimer for full terms, which is incorporated into these Terms by reference.
7. Payment, Billing and Cancellation
• Prices for consultations, medications and any subscription plans are shown at checkout.
• Certain products may be offered on a recurring subscription basis. You may cancel a subscription at any time through your account or by contacting us at support@walkonnutrition.com.
• Fees are generally non-refundable except as required by law or as set out in our Refund Policy.
8. Intellectual Property
All content on the Services, including text, graphics, logos and software, is owned by or licensed to WalkOn RX and is protected by intellectual property laws. You may not copy, reproduce or distribute any content from the Services without our written permission.
9. Third-Party Services
The Services may rely on or link to third-party services, including payment processors and pharmacy partners The Pharmacy Hub. We are not responsible for the acts or omissions of independent third parties.
10. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, EXCEPT AS PROHIBITED BY APPLICABLE LAW.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WalkOn RX WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICES.
12. Indemnification
You agree to indemnify and hold harmless WalkOn RX, its clinicians and partners from claims arising out of your misuse of the Services, your violation of these Terms, or your violation of any law or third-party right.
13. Dispute Resolution
If you have a dispute with WalkOn RX, contact us first at support@walkonnutrition.com and we will work with you in good faith to resolve it informally before either party pursues a formal claim.
14. Governing Law
These Terms are governed by the laws of the state in which WalkOn RX is organized, without regard to conflict-of-law principles.
15. Termination
We may suspend or terminate your access to the Services at any time, with or without cause, including for violation of these Terms. You may stop using the Services and close your account at any time.
16. Changes to These Terms
We may update these Terms from time to time. We will post the revised Terms with an updated effective date. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
